EB-5 Investments Step By Step Process
1. Initial Consultation
We begin with a free consultation to understand your goals and assess your eligibility. Our team provides an overview of the EB-5 process, timelines, and investment options within our real estate portfolio.
2. Select an EB-5 Investment Project
Choose from our USCIS-compliant, EB-5 qualified real estate projects designed to meet all program requirements, including job creation. We provide full documentation, economic impact reports, and risk disclosures.
3. Engage Immigration Attorney
You will work with an experienced EB-5 immigration attorney (we can recommend trusted partners) to prepare your immigration documents and support your I-526E petition.
4. Invest Funds in Escrow Account
Make the required capital investment of $800,000 (or $1,050,000) into the project’s secure escrow account. You will also pay the applicable administrative fee for project due diligence and processing.
5. File Form I-526E
Your attorney files Form I-526E with USCIS, providing evidence of:
- Lawful source of funds
- Job creation projections
- Project documentation
- Investor qualifications
Once approved, you and your eligible family members can apply for conditional green cards.
6. Conditional Green Card (2 Years)
Upon approval of I-526E and visa availability, you’ll receive a 2-year conditional green card. This allows you to:
- Live, work, and study anywhere in the U.S.
- Travel freely in and out of the country
During this time, your investment must remain at-risk and continue creating jobs.
7. File Form I-829 to Remove Conditions
90 days before your conditional residency ends, your attorney will file Form I-829 to remove the conditions on your green card. This petition must show that:
- The required investment was sustained
- 10+ jobs were created or are in progress
Once I-829 is approved, you and your family become unconditional permanent residents.
8. U.S. Citizenship Eligibility
After five years of permanent residency (starting from the date of your initial conditional green card), you may be eligible to apply for U.S. citizenship.
